What the Legislation module covers

On the Alberta NCSO exam, Legislation covers the Occupational Health and Safety Act, Regulation and Code, due diligence, worker and employer obligations, the three worker rights, and enforcement. It is one of ten modules, and the exam draws across all of them — which is why candidates who are strong on site but narrow in coverage still fail.

The three fundamental worker rights: RIGHT TO KNOW about hazards, RIGHT TO PARTICIPATE in safety activities, and RIGHT TO REFUSE dangerous work. These are protected by law - employers cannot retaliate for exercising them.

Why

The ACT is the enabling legislation. It gives government the authority to regulate and assigns high-level duties to employers, supervisors, and workers. The Code/Regulations contain the specific technical requirements.

What does 'Due Diligence' mean in OHS?

  1. Reporting all incidents to the government within 24 hours
  2. Completing all required government-mandated training
  3. Taking every reasonable precaution to prevent harm - proactively, before an incident correct
  4. Having all workers sign a safety waiver
Why

Due diligence = proactive. You must demonstrate that ALL reasonable precautions were taken BEFORE the incident. Post-incident actions do not satisfy due diligence. It is both a legal obligation AND a defence against strict liability charges.
